International labour standards (ILS) have been the primary vehicle for the International Labour Organization's (ILO's) action since it was created in 1919. Its status as a real international legislator clearly explains why the impact of ILS is generally measured by their incorporation into national legislation. Similarly, the task of the ILO's supervisory bodies such as the Committee of Experts on the Application of Conventions and Recommendations is often seen as engaging in a dialogue with state authorities aimed at reforming national legislation. Nevertheless, it would be wrong to believe that ILS, and, more broadly, the ILO's standards-related action, only target the parliaments and governments of member countries. ILS can only be fully respected if the people who apply the law at national level make use of them. Moreover, ILS, together with the associated international case law, offer a matchless source of inspiration to judges and lawyers in member countries. Countless examples show that national courts are hesitating less and less to draw not only on international labour conventions and recommendations but also on the work of the ILO's different supervisory bodies to interpret and complete their national law.
The ILO Training Centre accordingly intends to encourage the advanced training of judges, university teachers and other law professionals to enable them to make full use of the resources of international labour law in their daily practice.
The main objective of the course is to equip law professionals to implement International Labour Standards at national level. At the end of the activity, participants will be able to: - master the machinery and content of the ILS system; - use the tools and documents that allow an in-depth understanding of ILS; - use or teach ways of incorporating international labour law into national case law; - identify and use the added value of ILS in key areas such as freedom of association or non-discrimination.
